These Terms of Service (“Terms”) govern your access to and use of the House of McGrath website, online store, subscription services, and related offerings (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. Eligibility & Legal Drinking Age

Our Services are intended only for individuals who have reached the legal drinking age in their province or territory of residence.

By using the Services, you represent and warrant that:

  • You are of legal drinking age in your jurisdiction; and
  • You have the legal capacity to enter into binding agreements.

We reserve the right to refuse service to anyone for any reason at any time.

3. Products & Availability

All products are subject to availability.

We reserve the right to:

  • Limit quantities
  • Modify or discontinue products
  • Change product descriptions or pricing
  • Refuse or cancel orders

We make reasonable efforts to ensure product information is accurate; however, errors may occur.

4. Orders & Payment

By placing an order, you agree to provide current, complete, and accurate purchase information.

Payment is processed through secure third-party providers, including Shopify and related payment processors. Subscription services are managed through Recharge.

We reserve the right to cancel any order if:

  • Fraud or unauthorized activity is suspected
  • Payment cannot be processed
  • Product availability changes

If we cancel your order after payment has been processed, we will issue a refund where required.

5. Subscriptions

If you enroll in a subscription:

  • You authorize recurring charges according to your selected delivery frequency.
  • You may manage or cancel your subscription before the next billing cycle through your account portal.
  • Once a subscription order has been processed, it is considered final sale.

6. Third-Party Services

Beer and restaurant deliveries are fulfilled through Uber Eats and are subject to Uber Eats’ terms and policies.

We are not responsible for:

  • Delivery timelines
  • Service interruptions
  • Refund decisions made by third-party platforms

Your use of third-party platforms is governed by their respective terms.

7. Shipping, Returns & Refunds

Shipping timelines and fulfillment terms are outlined in our Shipping Policy.

Returns and refunds are governed by our Returns & Refund Policy.

All sales are final unless otherwise stated.

8. Intellectual Property

All content on this website, including but not limited to:

  • Logos
  • Branding
  • Product names
  • Images
  • Designs
  • Text
  • Graphics

is the property of McGrath and is protected under applicable intellectual property laws. "House of McGrath" is a trademark in Canada, owned by McGrath's Brewing Inc. 

You may not reproduce, distribute, modify, or use our content without prior written permission.

9. Prohibited Use

You agree not to:

  • Use the Services for unlawful purposes
  • Violate any applicable laws or regulations
  • Transmit viruses or malicious code
  • Attempt to gain unauthorized access to systems
  • Interfere with the security or functionality of the Services

We reserve the right to terminate access if these Terms are violated.

10. Disclaimer of Warranties

The Services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, McGrath disclaims all warranties, express or implied, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

We do not guarantee uninterrupted or error-free service.

11. Limitation of Liability

To the maximum extent permitted by applicable law, McGrath shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits or revenue
  • Loss of data

Our total liability shall not exceed the amount paid for the applicable product or service.

Nothing in these Terms limits liability where prohibited by law.

You agree to indemnify and hold harmless McGrath, its affiliates, and its officers, directors, and employees from any claims, damages, liabilities, or expenses arising from:

  • Your use of the Services

  • Your violation of applicable laws

13. Privacy

Your use of the Services is also governed by our Privacy Policy.

14. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Any disputes shall be resolved in the courts of Ontario, Canada.

15. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
